These Terms of Service govern your access to and use of The Speakesy Club as a user, member, subscriber, or purchaser of digital memberships and content on the platform. By creating an account, accessing The Speakesy, purchasing a membership, subscribing to a creator, or using any platform service, you agree to these Terms. If you do not agree, you must not use The Speakesy.

1. About The Speakesy Club

The Speakesy Club (speakesy.club) is a private membership platform that allows fans to access exclusive content, private streams, direct communication, and tiered membership experiences from their favourite creators. The Speakesy Club provides the technology that enables creator-fan interactions. The Speakesy Club is not responsible for guaranteeing any specific personal outcome or satisfaction from creator interactions.

2. Eligibility

You must be at least 18 years old to use The Speakesy Club. By using the platform you confirm that:

• you are legally capable of entering a binding agreement;
• you are not prohibited from using The Speakesy Club under applicable law;
• all information you provide is true, accurate, and complete;
• you will use the platform only for lawful purposes;
• you will comply with these Terms and all applicable Speakesy policies.

3. User Account

To access certain features, you must create an account. You are responsible for keeping your login credentials confidential, maintaining account security, and all activity occurring through your account. You must not share, sell, or transfer your account to another person.

4. Memberships and Payments

The Speakesy Club offers tiered memberships (Access, Inner Circle, Founding Member) priced in Indian Rupees. Memberships are billed monthly. You are responsible for reviewing tier details, pricing, and terms before purchasing. Payments are processed through third-party payment providers. Once a membership period starts, it is generally treated as consumed.

5. Cancellation

You may cancel your membership at any time. Cancellation stops future renewals but does not automatically refund the current billing period, past charges, or consumed access. Refunds are governed by our Refund Policy.

6. User Conduct

You agree to use The Speakesy Club respectfully and lawfully. You must not:

• harass, abuse, threaten, or exploit any user, creator, or Speakesy employee;
• send hateful, violent, obscene, abusive, or defamatory content;
• impersonate any person or create fake accounts;
• attempt to bypass payment or access control systems;
• engage in fraud, chargebacks misuse, or payment abuse;
• scrape, harvest, or misuse platform data or creator content;
• upload viruses, malware, or harmful code;
• violate any applicable law or Speakesy policy.

7. Prohibited Content

You must not upload, request, or distribute content involving:

• child sexual abuse material or exploitation of minors;
• non-consensual intimate content or revenge pornography;
• threats, violence, or self-harm encouragement;
• hate speech or targeted harassment;
• fraud, phishing, or financial abuse;
• copyright infringement or unauthorized use of third-party IP;
• anything prohibited by Speakesy policies or applicable law.

8. Creator Content and Platform Responsibility

Creator content, availability, pricing, and services are provided by creators. The Speakesy does not guarantee every creator statement, promise, or availability. The Speakesy may review complaints involving creator misconduct, fraud, or policy violations.

9. Intellectual Property

The Speakesy Club name, logo, brand, platform, software, and all associated materials are owned by or licensed to The Speakesy Club. You must not copy, modify, distribute, or commercially exploit our intellectual property without prior written permission.

10. Disclaimers

The Speakesy Club is provided on an 'as is' and 'as available' basis. We do not guarantee uninterrupted service, error-free operation, or that all user expectations will be met. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Limitation of Liability

To the maximum extent permitted by law, The Speakesy Club will not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform, including loss arising from creator conduct, third-party service failure, payment gateway delay, or suspension for policy violation.

12. Governing Law

These Terms are governed by the laws of India. Disputes arising from these Terms shall be subject to the jurisdiction of courts in India.

13. Changes to These Terms

The Speakesy Club may update these Terms from time to time. Continued use of the platform after updates are published constitutes acceptance of the updated Terms.
